2. Changes to these Terms
We may update these Terms from time to time to reflect changes to our Services, operations, or legal requirements. Changes take effect when posted on this page. Your continued use of the website or Services after changes are posted constitutes acceptance of the updated Terms.
3. Eligibility & accounts
3.1 Age requirement
You must be 18 years or older to purchase paid Services unless a programme is explicitly designed for under‑18s and includes appropriate consent processes.
3.2 Account security
Some Services require an account. You are responsible for maintaining the confidentiality of your login details and for all activity carried out through your account.
We may suspend or terminate access if we reasonably believe you have breached these Terms, your account has been compromised, or your use poses risk or harm to Moxie, other users, or third parties.
4. Acceptable use
You agree not to:
use the website or Services unlawfully;
attempt unauthorised access to systems or data;
interfere with security, availability, or performance;
upload malware, spam, or harmful content;
misuse community areas (harassment, hate, threats, unlawful behaviour).
We reserve the right to restrict, suspend, or terminate access where these Terms are breached.
5. Nature of Moxie Services (important)
Moxie provides personal development tools, experiences, coaching support, and educational content designed to support reflection, behaviour change, and intentional life design.
Moxie Services are not medical, clinical, therapeutic, psychological, legal, or financial services, and do not constitute professional advice. You remain fully responsible for your choices, actions, and outcomes.
If you require clinical support or are in crisis, you should seek assistance from qualified professionals or emergency services.
6. Use of Artificial Intelligence (AI) & associated risks
6.1 Where AI is used
Moxie uses AI‑powered tools across aspects of the website, digital platforms, assessments, coaching support, and content delivery (including the Moxie Circle).
AI outputs are designed to support insight, reflection, and learning only. They must not be relied upon as professional, medical, therapeutic, psychological, financial, or legal advice.
6.2 AI limitations & responsibility
You acknowledge and agree that:
AI‑generated content may be incomplete, inaccurate, or not fully personalised;
AI produces outputs based on probabilities and patterns, not verified facts or human judgement;
any decisions or actions taken based on AI outputs are taken at your own discretion and risk.
Moxie makes no guarantees regarding the accuracy, suitability, or outcomes of AI‑generated content.
6.3 Transparency
Where appropriate, we take reasonable steps to indicate when AI systems are being used or when content has been AI‑generated or AI‑assisted.
6.4 Human coaching + AI
Where AI tools are combined with optional human coaching, responsibility for interpretation and application remains with you. AI does not replace professional judgement or advice.
7. Intellectual property
All content and materials within Moxie Services — including text, imagery, videos, assessments, methodologies, frameworks, tools, logos, and design elements — are owned by or licensed to Moxie and protected by applicable intellectual property laws.
You may not reproduce, distribute, modify, sell, or create derivative works without prior written permission, except where permitted by law.
8. Payments, pricing & billing
8.1 Pricing
Prices are shown at checkout or on invoice. Taxes may apply depending on your location and the nature of the Service.
8.2 Payment processing
Payments are processed via third‑party providers. You authorise us to charge the payment method provided.
8.3 Failed payments
If payment fails, access may be suspended until payment is received.
8.4 Subscriptions
Memberships or subscriptions may renew automatically unless cancelled in accordance with instructions provided at purchase or via your account.
9. Cooling‑off rights & statutory exceptions
9.1 General right
You may have a 14‑day cooling‑off right for distance contracts, subject to legal exceptions.
9.2 Retreats
Cooling‑off rights do not apply to leisure services booked for a specific date (including retreats).
9.3 Digital content
For digital content supplied immediately with your consent and acknowledgement, cancellation rights are lost once access begins.
9.4 Early service delivery
If you request a service to begin within the cancellation period, you may be required to pay for services already delivered and may lose cancellation rights once fully performed.
Nothing in these Terms affects statutory rights that cannot be excluded.
10. Refunds (digital services, memberships & coaching)
10.1 General
Refund eligibility depends on the Service purchased, delivery status, and applicable law. Approved refunds are typically processed within 14 days.
10.2 Memberships
Unless stated otherwise:
membership fees are non‑refundable once a billing period has started;
future renewals may be cancelled at any time.
10.3 Coaching
Cancellation and rescheduling rules are provided at booking. Missed sessions may be chargeable.
11. Results, Outcomes & the 90‑Day Commitment
Moxie programmes — including the Moxie Circle and any programme described as a 90‑day plan — are designed to support meaningful progress when followed fully and consistently.
11.1 90‑day framework
References to “90 days” describe the structure of the programme, not a guarantee of results within that timeframe.
11.2 Conditions for results
Results within 90 days (or any timeframe) are strictly conditional on the participant:
following the entire Moxie system exactly as prescribed;
engaging with daily coach check‑ins (AI and/or human, where included);
completing all required actions, reflections, practices, and reviews;
maintaining consistent participation throughout the programme;
applying insights in real‑world contexts;
engaging honestly and with intent.
Partial participation, inconsistency, or programme modification materially reduces effectiveness and invalidates any expectation of results.
11.3 No guarantees
Moxie makes no guarantees regarding:
specific outcomes,
behavioural or performance change,
financial, professional, or wellbeing results,
transformation within any fixed period.
Results vary based on individual effort, consistency, context, and factors outside Moxie’s control.
11.4 Responsibility
You acknowledge that:
outcomes depend on your actions and engagement;
Moxie provides structure, tools, coaching, and support — not outcomes;
failure to follow the programme as designed (including daily check‑ins) may significantly limit results.
11.5 No outcome‑based refunds
Perceived lack of results or progress does not entitle you to a refund where the programme has been delivered as described.
Retreat‑Specific Terms
12. What’s included
Unless stated otherwise, retreat pricing includes accommodation and luxury transfers.
Flights are not included and remain your responsibility.
13. Health, safety & participation
You are responsible for ensuring you are fit to participate and for disclosing relevant medical, dietary, or accessibility needs. Participation is voluntary.
We may refuse or limit participation where safety concerns arise.
14. Behaviour & conduct
Unsafe, disruptive, abusive, or inappropriate behaviour may result in removal from a retreat without refund.
15. Retreat payments
Payment terms are shown at checkout or invoice. Failure to pay may result in cancellation.
16. Retreat cancellations & refunds
Because retreats are leisure services provided on specific dates, cooling‑off rights do not apply.
More than 60 days before start date: £500 refundable
60–30 days before start date: 50% refundable
Less than 30 days before start date: no refund
Waitlist
If your place is filled from a waitlist, we may (at our discretion) offer a partial refund or credit, less £500 and any non‑recoverable third‑party costs.
17. Transfers
Bookings may be transferred to another eligible person, subject to supplier constraints. An admin fee may apply.
18. Cancellation by Moxie
If we cancel a retreat, you will be offered a transfer or a refund of fees paid to Moxie. We are not responsible for external costs (e.g. flights).
19. Force majeure
We are not liable for delays or failures caused by events beyond our reasonable control. Reasonable remedies will be offered where possible.
20. Third‑party links
We are not responsible for third‑party websites, services, or policies linked from our Services.
21. Limitation of liability
Services are provided “as is” and “as available”. To the fullest extent permitted by law, Moxie is not liable for indirect, consequential, or outcome‑based losses, including reliance on AI or coaching content.
22. Governing law & jurisdiction
These Terms are governed by and interpreted in accordance with the laws of England and Wales.
The courts of England and Wales shall have exclusive jurisdiction.
